Terms & Conditions

1. Scope

These terms govern counselling services provided by Theresa Frische ("the Counsellor") to private clients ("the Client"). They apply to individual counselling, couples counselling, and participation in group offerings such as the Weekly Wellbeing Community.

2. Nature of the service

The Counsellor provides psychological counselling (Beratung). Counselling is not psychotherapy, not medical treatment, and not a substitute for either. It does not involve diagnosis, medical care, or the treatment of illness. Where a Client's situation calls for medical or psychotherapeutic care, the Counsellor will say so and, where possible, help the Client find appropriate support.

Counselling is a collaborative process. No particular outcome or result is promised or guaranteed.

3. Formation of the contract

Enquiries via the website are an invitation to make contact and do not create a contract. A contract is formed when an appointment is expressly confirmed by the Counsellor. The free 15 minute discovery call is offered without charge and creates no obligation on either side.

4. Sessions and format

Sessions are held online by video, in German or English. Individual sessions last 60 minutes; couples sessions 60 to 120 minutes. The Client is responsible for a stable internet connection, a suitable device, and a private, undisturbed setting. Where a session cannot proceed for technical reasons on the Counsellor's side, it will be rescheduled at no cost.

5. Fees and payment

Fees are agreed individually at booking. Unless agreed otherwise, an invoice is issued after the session and is payable within 14 days. Clients outside the EU may be asked to pay in advance. In accordance with § 19 UStG (small business regulation), no VAT is charged.

Sessions are self-pay. They are not billed to, or reimbursed by, statutory or private health insurance.

6. Cancellation and rescheduling

Appointments may be cancelled or rescheduled free of charge up to 24 hours before the agreed time. For cancellations inside 24 hours, or where the Client does not attend, the full session fee is payable. In cases of illness or genuine emergency the Counsellor will apply this at her discretion.

The Counsellor will give as much notice as possible if she needs to reschedule, and no fee arises in that case.

7. Confidentiality

Everything discussed is treated as confidential. Information is not shared with third parties without the Client's consent, save where disclosure is required by law or where there is a serious and immediate risk to the life or safety of the Client or another person. Where the Counsellor works through an employer-funded programme, no session content is reported to the employer.

8. Right of withdrawal (Widerrufsrecht)

Where the Client is a consumer and the contract is concluded remotely, the Client has the right to withdraw within 14 days of entering the contract, without giving reasons. To exercise it, the Client notifies the Counsellor in clear terms (by email is sufficient) at info@theresafrische.com.

If the Client expressly requests that counselling begin before the end of the withdrawal period, the Client owes a proportionate amount for services already provided. The right of withdrawal lapses once the service has been fully performed, where the Client expressly consented to early commencement and acknowledged that consequence.

9. Limits of liability

The Counsellor is fully liable for damage caused intentionally or by gross negligence, and for injury to life, body or health. Otherwise liability is limited to a breach of a material obligation and to foreseeable damage typical of this kind of contract. Nothing in these terms limits liability where the law does not permit it.

10. Crisis situations

Counselling is not a crisis or emergency service and is not monitored outside session times. In an emergency the Client should contact local emergency services or a crisis line. Details are given on the contact page of this website.

11. Data protection

Personal data is processed as described in the privacy notice on this website.

12. Governing law and final provisions

German law applies. The place of performance is Freiburg im Breisgau. If any provision is or becomes invalid, the remaining provisions are unaffected.
